Riding home from work this lunchtime, I heard a screach of tyres and was then wallopped from behind by a car. Was lucky to hit the deck at the side of the road and not elswhere - and landed on my derrierre.
bike not looking too good
Police and ambulance came on the scene, but I doubt if the driver will even get a telling off - scary thoughts of what might have been. _________________ The starting point of all achievement is Desire.

bike is poorly - happened on the A60 between Brush and Cotes - just glad I went left and not right  _________________ The starting point of all achievement is Desire.

Glad to hear you are ok.Depending on how badly done by you feel I would speak with the police and explain that you were just cycling along in a proper manner and in the circumstances cant put the collision down to anything but a lack of due care on the part of the driver.At the very least they will consider a prosecution and it may just make the clown think twice about his manner of driving.I work in Loughborough and drive down that road daily,there are so many near misses on there. |

You are joking? He was out of control of his car, hit you, damaged your bike, scarred you shitless and injured you.

Cops in these cases are allowed as much discretion as they can get away with, which can be a lot.
Without knowing all the circumstances I would say that the facts speak for themselves and it would warrant the driver at least being interviewed, ring up and throw your toys out. If you don't get satisfaction then complain until you do.

I had someone hit me a few years back and he got nowt also, time things changed like in Holland if a driver hits u in a car he's at fault watever the situation, and you get a hugh lump sum!! |

It's only worth charging him if they've a good chance of getting a conviction; otherwise it's just a waste of money. No witness, no conviction, few grand in legal costs down the drain.
As a civil case has a lower standard of proof (balance of probabilities rather than beyond reasonable doubt), it shouldn't adversely affect any claim you make that there has not been a criminal conviction.
(Glad the outcome was the sort that can be adequately compensated for by a court paying you money). |
