not even a statement required from me - apparently I need an independent witness ( Like I could find one whilst lying on the ground fearing to move ) |
I'll do it for 15% of the compensation Dave.
Glad to hear you're OK _________________ World Masters Drive HillClimb For Taureans Category C Champion 2013.

Dave
This all sounds familar i got hit head on a few years ago, by white man van cutting a corner, did seven ribs collar bone and shoulder blade when I sheared his wing mirror off with my shoulder. He missed my mate by inches. To be fair the police were brilliant (and reported him for the driving offences he'd committed) but my mate wasn't classed as an independent witness... and despite my bike, his wing mirror and a pile of glass spread across the inside apex of the bend he had cut, clearly proving where impact was the CPS didn't prosecute due to lack of independent witness's.
I'm still bitter about the outcome, 10 years on, but there was little I as one individual could do. BC took the case on and got me a reasonable but reduced compensation payout as no liability was allocated to either party.
The driver was a lucky man, but then again so was I, that's life, it's unfair and I was thankful to be alive. The best advice I can give is don't waste the time I have being bitter.
Get well soon

i think the police are only interested if you die to be honest and even then, if no witnesses come forward your family has to live with the insult of nothing being done. Absolute joke this country. (and i'm in a bad mood cos its raining, again, on weekend, again) _________________ www.freddibnahheritagecentre.co.uk |

Sorry was ment to ask if the bike was ok! Where did it happen? |
bike is poorly - happened on the A60 between Brush and Cotes - just glad I went left and not right |
I think when you say 'Brush' your referring to the factory on the outskirts of Loughie? If it is I know the bit of road you are referring to and I seldom rode it whilst working out there. Busy road and 'feels' too narrow. Glad you are ok Dave. _________________ Imagination is the war against reality.... |

Sorry but that is ridiculous, sounds like they think its only worth charging him when he kills someone. |
Even then they might not!!
The odds are stacked ridiculously against cyclists these days in UK, and the police give the impression that they are simply not bothered.
Glad you survived the incident Dave. That's the main thing. |

It's clear from this thread (amongst a gazillion others) that a change in the law is required so that in big vs. little, the big one is always held to blame unless there's an independent witness.
We might not always like this as cyclists; don't hit a pedestrian, for instance, cos you'll be held to blame. _________________ "For every complex problem there is an answer that is clear, simple, and wrong." H. L. Mencken
